This website, its subdomains, and additional online resources provided for use, including but not limited to https://www.iptc.dog (hereinafter collectively referred to as “Websites”), are owned and operated by International Puppy and Trainer Contest (“IPTC”) and may be used for informational purposes only. By using the Websites or downloading materials from the Websites, you agree to abide by the terms and conditions set forth in this Notice. If you do not agree to abide by these terms and conditions do not use the Websites or download materials from the Websites.
  3. Limited License
    1. Subject to the terms and conditions set forth in this Notice, IPTC grants you a non-exclusive, non-transferable, limited right to access, use and display the Websites and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the Websites, deface or attempt to deface the Websites, or otherwise alter or attempt to alter the content of the Websites in any way.
    2. IPTC authorizes you to view and download the information (Materials) from the Websites only for your personal, non-commercial use, unless explicitly authorized by IPTC. This authorization is not a transfer of title in the Materials and is subject to the following restrictions:
      1. You must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials.
      2. You may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose.
      3. You must not transfer the Materials to any other person unless you give them Notice of, and they agree to accept, the obligations arising under these terms and conditions of use.
      4. You agree to abide by all additional restrictions displayed on the Websites as it may be updated from time to time.
      5. The Websites, including all Materials, are copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of the Websites and to prevent any unauthorized copying of the Materials. Except as expressly provided herein, IPTC does not grant any express or implied right to you under any patents, trademarks, copyrights or trade secret information.

    1. INFORMATION ON THE WEBSITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

IN NO EVENT WILL IPTC BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THE WEBSITES, OR ON ANY OTHER HYPERLINKED WEBSITE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, LOSS OF BUSINESS OPPORTUNITY, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR DAMAGES CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. IN NO EVENT SHALL THE LIABILITY OF IPTC AND IT’S SUPPLIERS RELATING IN ANY WAY TO THE SITE, THE SERVICES, OR THE CONTENT EXCEED $100 OR THE MINIMUM AMOUNT ALLOWABLE UNDER APPLICABLE LAW, WHICHEVER IS GREATER, REGARDLESS OF THE LEGAL THEORY ASSERTED FOR SUCH LIABILITY, WHETHER IN CONTRACT, TORT, WARRANTY, OR OTHERWISE. IF YOU ARE DISSATISFIED WITH THE SITE, THE SERVICES, THE CONTENT, OR THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE, THE SERVICES, AND/OR THE CONTENT.
    3. Information on the Websites may contain technical inaccuracies or typographical errors. Information may be changed or updated without Notice. IPTC may also make improvements and/or changes in the products and/or the programs described in this information at any time without Notice.
    4. Any comments or materials sent to IPTC including feedback data, such as questions, comments, suggestions, or the like regarding the content of any such documents (collectively, Feedback), shall be deemed to be non-confidential. IPTC shall have no obligation of any kind with respect to such Feedback and shall be free to reproduce, use, disclose, exhibit, display, transform, create derivative works and distribute the Feedback to others without limitation. Further, IPTC shall be free to use any ideas, concepts, know-how or techniques contained in such Feedback for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products incorporating such Feedback.
    5. Information IPTC publishes on the Websites may contain references or cross references to IPTC products, programs and services that are not announced or available in your territory or country. Such references do not imply that IPTC intends to announce such products, programs or services in your territory or country. Consult your IPTC sales contact for information regarding the products, programs and services that may be available to you.
    6. As a convenience to you, IPTC may provide, on the Websites, links to Web sites operated by other entities. If you use these Sites, you will leave the Websites. If you decide to visit any linked Sites, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. IPTC makes no warranty or representation regarding, and does not endorse, any linked Web sites or the information appearing thereon or any of the products or services described thereon. Links do not imply that IPTC or the Websites sponsor, endorse, are affiliated or associated with, or are legally authorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked Site is authorized to use any trademark, trade name, logo or copyright symbol of IPTC or any of its affiliates or subsidiaries.
  5. Copyright: All content, materials and programs included on or associated with the Websites, including the code, text, graphics and logos, are the exclusive property of or licensed to IPTC unless explicitly stated otherwise. In addition, the overall look and feel and the compilation of all materials and content on the Websites are the exclusive property of IPTC.
  6. Trademarks
    1. The trademarks, service marks and logos (Trademarks) used and displayed on the Websites are registered and unregistered Trademarks of IPTC and others. Nothing on the Websites should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Websites, without the prior written permission of the Trademark owner. IPTC aggressively enforces its intellectual property rights to the fullest extent of the law. The name of IPTC, IPTC logo or the other IPTC formatives may not be used in any way, including in advertising or publicity pertaining to distribution of materials on the Websites, without prior, written permission from IPTC.
    2. IPTC prohibits use of IPTC logo as part of a link to or from any Site unless IPTC approves establishment of such a link in advance in writing. Fair use of IPTC’s Trademarks requires proper acknowledgment. Other product and company names mentioned in the Websites may be the Trademarks of their respective owners.
  7. Indemnification: You understand and agree that you are personally responsible for your reliance upon any information or recommendation provided on the Websites, its Content and Materials, by IPTC personnel, your behavior on the Websites, and your Submissions. You agree to indemnify, defend and hold harmless IPTC and IPTC’s joint venturers, business partners, licensors, employees, agents, officers, directors, managers, owners, and any third-party information, Software, Content, Materials, and Web Services Application providers to the Websites and Services from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, special, consequential, punitive, exemplary and indirect damages), physical or otherwise, and reasonable attorneys’ fees, resulting from or arising out of your use, misuse, or inability to use the Websites, the Services, or the Content and Materials, participation in any IPTC events, your reliance upon any information or recommendation provided by IPTC personnel, your submissions, or any violation by you of these Terms of Use.
  8. Prohibited User Conduct
    1. You are prohibited from compromising the security or tampering with system resources and/or accounts related to the Websites. The use or distribution of tools designed for compromising security (e.g., password guessing manually or through programs, cracking tools, or network probing tools) is strictly prohibited. IPTC may monitor your use of the Websites including without limitation the Services, to ensure your compliance with these Terms of Use. If you become involved, or are suspected to have become involved, in any violation of these Terms of Use, IPTC reserves the right to investigate your activities for its own purposes and release the details of your violations to others in IPTC’s sole discretion, including without limitation to governmental authorities, private investigators, or other users of the Websites in order to assist them in resolving security incidents.
    2. You agree not to use the Websites or any Services or Materials in any manner that violates any laws or infringes or misappropriates the intellectual property of, or interferes with the rights of, third parties. You may not take any action that imposes, or may impose in IPTC’s sole discretion, an unreasonable or disproportionately large load on the Websites’ infrastructure or interfere or attempt to interfere with the proper working of the Websites or any activities conducted on the Websites, or bypass any robot exclusion headers or other measures IPTC may use to prevent or restrict access to the Websites.
    3. The Websites may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, reviews, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
      1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others including without limitation engaging in activity that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, ethnicity, gender, sexual orientation, physical ability, age, religion or nationality or that insults the victims of crimes against humanity by contesting the existence of those crimes.
      2. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, material, or information.
      3. Upload, display, or otherwise make available files that contain images, photos, software, or other material that infringes any copyright, trademark, patent, trade secret, privacy right, publicity right, confidentiality obligation or other proprietary right of any party.
      4. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
      5. Use any material or information, including images, software, designs, photographs, or other material which is made available through the Websites in any manner that infringes any copyright, trademark, patent, trade secret, privacy right, publicity right, confidentiality obligation or other proprietary right of any party.
      6. Advertise or offer to sell or buy any goods or services for any business purpose, unless IPTC specifically allows such messages.
      7. Conduct or forward surveys, contests, pyramid schemes or chain letters.
      8. Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
      9. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
      10. Restrict or inhibit any other user from using and enjoying the Communication Services.
      11. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
      12. Harvest or otherwise collect information about others, including e-mail addresses, without consent from IPTC and them.
      13. Violate any applicable laws or regulations.
      14. Create a false identity for the purpose of misleading others.
    4. IPTC has no obligation to monitor the Communication Services. However, IPTC reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. IPTC reserves the right to terminate your access to the Websites, Services, Materials, Content, and any or all of the Communication Services at any time without notice for any reason whatsoever. IPTC reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in IPTC’s sole discretion. Always use caution when giving out any personally identifying information about yourself in any Communication Service. Without limiting these Terms of Use, IPTC does not control or endorse the content, messages, submissions, or information found in any Communication Service and IPTC specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service, including, without limitation, your use of any Submissions and collaborations with other users of Communication Services.
  9. External Links to the Site: All links to the Websites must be approved in writing by IPTC, except that IPTC consents to links in which:
    1. The link is a text-only link containing only the name “IPTC”, “International Puppy and Trainer Contest”, or “IPTC Weekend”,
    2. The link “points” only to https://www.iptc.dog and not to deeper pages,
    3. The link, when activated by a user, displays that page full-screen in a fully operable and navigable browser window and not within a “frame” on the linked website, and
    4. The appearance, position, and other aspects of the link may neither create the false appearance that an entity or its activities or products are associated with or sponsored by IPTC nor be such as to damage or dilute the goodwill associated with the name and trademarks of IPTC or its affiliates. IPTC reserves the right to revoke this consent to link at any time in its sole discretion.
  10. Forward-Looking Statements: You should not place undue reliance on forward-looking statements, since such statements speak only as of the date they are made. Certain statements contained in the Websites may constitute “forward-looking statements” within the meaning of the federal securities laws. Words or phrases such as “should result,” “are expected to,” “IPTC anticipates,” “IPTC estimates,” “IPTC projects” or similar expressions are intended to identify forward-looking statements. These statements are subject to certain risks and uncertainties that could cause actual results to differ materially from IPTC’s historical experience and its present expectations or projections. These risks and uncertainties include, but are not limited to:
    1. conditions affecting the availability, acquisition, development and ownership of real estate;
    2. unanticipated weather conditions;
    3. stability of costs and availability of sourcing channels;
    4. IPTC’s ability to attract, train and retain highly-qualified associates and members;
    5. general economic conditions;

  11. International Users and Choice of Law
    1. The Websites are controlled, operated and administered by IPTC from its offices within the United States of America. IPTC makes no representation that materials on the Websites are appropriate or available for use at other locations outside of the United States and access to them from territories where their contents are illegal is prohibited. You may not use the Websites in violation of U. S. export laws and regulations. If you access the Websites from locations outside of the United States, you are responsible for compliance with all local laws. The laws of the State of Massachusetts shall govern these Terms and Conditions of use, without giving effect to its conflict of laws provisions.
    2. This Notice constitutes the entire agreement between IPTC and you with respect to your use of the Websites. Any cause of action you may have with respect to your use of the Websites must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Notice or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of the Notice, and the remainder of this Notice shall continue in full force and effect.
  12. Security: The Websites have security measures in place and IPTC will use its commercially reasonable best efforts to protect the loss, misuse and alteration of the information under IPTC’s control. IPTC’s computing equipment is in a secured environment. The information is password protected and is not accessible to unauthorized employees or personnel at any time. Unfortunately, no data transmission over the Internet can be 100% secure. As a result, IPTC cannot warrant the security of any information you transmit to us and you do so at your own risk.
  13. Member Events: Thank you for your interest in participating in an International Puppy and Trainer Contest (“IPTC”) event. By registering for an event, you agree to these terms. In this section, words like ‘holder’, ‘bearer’, and ‘registrant’ will refer to you – the person who will register for the event. On the other hand, ‘our’, ‘us’, ‘we’, ‘issuer’, ‘provider’ and similar terms will indicate the organizers of IPTC.
    1. By opting to register, allocate or possess tickets to IPTC member events, you automatically agree to our Terms and Conditions. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not register or try to enter the IPTC events’ premises.
    2. Any fees assesed as part of registration for an IPTC event are dues, fees, or charges for a one (1) year membership to IPTC.
    3. Please note that IPTC reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected on this website. These changes will relate back to the date of registration for IPTC events.
    4. The fees for one (1) IPTC event registration will be displayed on this website for each event. This figure is non-negotiable.
    5. The registration represents a revocable license for you to access IPTC events on the indicated dates when the event is scheduled to be hosted. The license includes the revocable right to attending the IPTC event. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.
    6. The bearer has to assume full responsibility of the IPTC event registration ticket, once they receive it. IPTC has no liabilities – financial, legal, or otherwise – in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.
    7. Kindly note that https://www.iptc.dog is the sole authorized source for IPTC event registrations. If you obtain your ticket(s) from any other unauthorized source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. The issuer has the right to dishonor such stolen/counterfeit registrations and declare them as void.
    8. The IPTC event registration tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).
    9. Please note that IPTC event registration tickets cannot be redeemed against cash, credits, or any other benefits.
    10. IPTC has the right to investigate if there has been any violation of the registration and ticketing terms and conditions. In case of any conflicts, the decision of IPTC will be deemed final (i.e., the issuer will remain the final arbiter in cases of disputes).
    11. The event service will be deemed to have been delivered in its entirety as soon as the IPTC event starts. From that point on, no refund requests will be entertained.
    12. If you are not able to access any particular section(s) of the venue due to delays, federal regulations, organizer policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will not be eligible for any refunds or future credits.
    13. If an IPTC event is cancelled in its entirety due to any unforeseen circumstances, IPTC has the sole and absolute right to reschedule the event, or issue a partial/full refund, or not issue any refunds. Please note that the decision of the issuer in such cases will be deemed final and binding.
    14. If an IPTC event is cancelled due to any factors or causes not in the control of the issuer, the latter may offer a partial or full refund, or no refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, delays in production, and the like. Once again, the decision of IPTC will be considered final.
    15. If an IPTC event has to be rescheduled to other dates, you will not be eligible for any refunds. In case the event is fully canceled, any refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.
    16. Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, have to be borne by the registrant. IPTC cannot be, in any way, held liable for that.
    17. All ticket registrations are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations.
    18. Unless noted, any IPTC event is a ‘rain or shine’ event. By registering for the event, you automatically confirm that you/the attendee(s) are of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending an IPTC event is 18.
    19. If it is proven beyond doubt at the venue that an attendee is below the ‘minimum age’, they will not be granted entry to the IPTC event or will be removed from the event. No refunds, full or partial, will be issued either.
    20. At the time of entering the event venue, you may be required to produce the registration ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.
    21. By registering for IPTC event tickets and presenting the same at the venue, you give your consent to IPTC to collect certain information about yourself (name, address, date of birth, etc.) for verification and storage.
    22. You hereby agree to forego all types of surcharge claims – full or in part – and all claims & entitlements related to it.
    23. IPTC does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.
    24. IPTC events follow a common ‘zero-tolerance policy’ towards unauthorized drug usage or carrying at the venue, AND towards any type of behavior/actions that violate our Code of Conduct, our Diversity & Inclusion Policy, or our Terms and Conditions. If you are found in possession of prohibited items at an IPTC event and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event registration ticket(s) will become void from that point on, you will be removed, and depending on severity the authorities will be notified.
    25. Please note that you register for IPTC event tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.
    26. In all cases of disputes between the registration ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final. In case a dispute cannot be resolved, the help of an independent third-party arbiter will be sought.
    27. Please note that photographs and footage will be taken throughout IPTC Events. These will be used by IPTC without limitations for marketing and publicity in our publications, on our website, in social media, or in any third-party publication. Please contact an IPTC staff member if you have any concerns or if you wish to be exempted from this activity, otherwise you consent to being photographed or recorded during IPTC Events for use as outlined above.
  14. User Transactions and Purchases: If you wish to purchase any product or service made available through the Websites including (but not limited to) items sold by IPTC and IPTC memberships, you may be asked to supply certain information relevant to your Transaction including, without limitation, information about your method of payment (such as your payment card number and expiration date), your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to IPTC the right to provide such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction. All descriptions, images, references, features, content, specifications, products and prices of products and services described or depicted on the Websites are subject to change at any time without notice. Certain weights, measures, and other descriptions are approximate and are provided for convenience purposes only. The inclusion of any products or services on the Websites does not imply or warrant that these products or services will be available. It is your responsibility to ascertain and obey all applicable local, state, federal, and international laws (including minimum age requirements) in regard to the receipt, possession, use, and sale of any item purchased from the Websites. By placing an order, you represent that the products ordered will be used only in a lawful manner. IPTC reserves the right, with or without prior notice, to do any one or more of the following: limit the available quantity of or discontinue any product or service; impose conditions on the honoring of any coupon, coupon code, promotional code, or other similar promotion; bar any user from making or completing any or all Transaction(s); and refuse to provide any user with any product or service. You agree to pay all charges that may be incurred by you or on your behalf through the Websites, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. In addition, you remain responsible for any taxes that may be applicable to your Transactions. IPTC does not offer additional discounts on large orders of a single item or on large orders of many individual items. In addition, we reserve the right to limit quantities on orders placed by the same account, on orders placed by the same method of payment, and on orders that use the same billing or shipping address. We will notify you if such limits are applied. IPTC reserves the right to prohibit purchases of any merchandise to resellers. Resellers are defined as a company or an individual that purchases goods with the intention of selling them rather than using them.
  15. Returns and Refunds: All purchases made using our Websites are covered by a 14 day return policy. You are guaranteed a full refund within this period as long as the item is returned is in retail condition, unused, in the original packaging, and resalable. Unless the item sold is faulty, the customer is responsible to pay for any costs to return the item, including but not limited to shipping. IPTC, at its sole discretion, will provide refunds via the original form of payment, if available. Exceptions to this policy include event tickets after the start time of the event has passed.   16. Errors & Inaccuracies: IPTC strives to display as accurately as possible the colors of the products shown on the Websites; however, IPTC cannot and does not guarantee that your monitor’s display of any color will be accurate. If an item is out of stock, IPTC, may, in its sole discretion and at no extra cost to you, substitute another item for the out-of-stock item if IPTC, in its sole discretion, determines that the identical brand and product is available in a form that is of equal or greater value, for example, larger quantity, packaged with a trial sample, or with updated product packaging. IPTC’s acknowledgement of an order means that your order request has been received; it does not mean that your order has been accepted or shipped or that the price or availability of an item has been confirmed. IPTC makes a conscientious effort to describe and display its products and services accurately on the Websites.
